IHC judges challenge transfer of intra-court appeal to Federal Constitutional Court

The judges further argued that Supreme Court judgments clearly outline the principles governing the separation of powers.

ISLAMABAD (Dunya News) - Judges of the Islamabad High Court have challenged the hearing of their intra-court appeal in the Federal Constitutional Court.

In a petition filed by four IHC judges, they requested that the intra-court appeal be sent back to the Supreme Court. The judges argued that the appeal was transferred to the constitutional court due to the 27th Constitutional Amendment, but the amendment itself is contrary to the Constitution.

They stated in their petition that the legislature, executive, and judiciary were established under the Constitution of 1973, which is based on three pillars. The Constitution clearly defines the separation of powers and limits of each organ. They added that the power to amend the Constitution cannot be used to abolish or undermine the judiciary.

The judges further argued that Supreme Court judgments clearly outline the principles governing the separation of powers.
