PHC halts ECP from further action against Zartaj Gul in disqualification case

The election commission had disqualified her after ATC Faisalabad verdict

PESHAWAR (Dunya News) –The Peshawar High Court (PHC) on Tuesday barred the Election Commission of Pakistan (ECP) from taking further action against Pakistan Tehreek-e-Insaf (PTI) leader Zartaj Gul in a disqualification case.

A two-member bench comprising Justice Waqar Ahmed and Justice Ijaz Khan heard the petition filed by Zartaj Gul challenging her disqualification.

During the hearing, the counsel for the petitioner informed the court that the anti-terrorism court (ATC) in Faisalabad had sentenced Zartaj Gul to ten years in prison in cases related to May 9 violence. Following that, on August 5, the ECP disqualified her along with other members.

Justice Waqar Ahmed inquired why the petitioner had not approached the Lahore High Court instead. The counsel responded that similar petitions by PTI leaders Omar Ayub and Shibli Faraz were already being heard by the PHC, and both had been disqualified in the same case.

Justice Waqar remarked that this petition would also be heard along with the others and added that the court would also examine the question of jurisdiction during the next hearing.

The court has issued notices to the election commission and other respondents, seeking their replies, and adjourned the hearing.
