PESHAWAR (Dunya News) – The Peshawar High Court on Monday suspended arrest warrants against Khyber Pakhtunkhwa Chief Minister Ali Amin Gandapur and restrained authorities from arresting him.
The arrest warrants were issued by a senior Islamabad civil judge on July 19 and directed him to appear till July 21.
The case was heard by a two-member bench comprising Justice Ijaz Anwar and Justice Dr Khurshid Iqbal.
The petition was filed by the CM through his lawyer, Bashir Khan Wazir who informed the court that he had obtained protective bail from the Peshawar High Court in multiple cases. However, in one case, a senior civil judge in Islamabad issued arrest warrants on July 19, ordering his arrest and appearance in court by July 21.
The lawyer stated that the CM was unaware of these warrants, as no notice was served to him. However, he noted that Gandapur had been granted protective bail in several cases by the PHC and was appearing in those cases.
However, he was not informed of the IHC's ’s warrants or the hearing date, which prevented his appearance. The lawyer added that the court order was received after the scheduled hearing date had passed, making it impossible for CM to appear.
He emphasised that, as the province’s chief executive, Gandapur’s appearance in Islamabad was not feasible under the current circumstances, but he now wishes to appear before the relevant court.
Wazir requested the court to suspend the arrest warrants. The PHC granted the request, suspending the warrants and barring authorities from arresting Gandapur. The court further instructed the petitioner to appear before the relevant court.
