Illegal marriage case: IHC orders session's court to decide Imran, Bushra Bibi's pleas within a month

ISLAMABAD (Dunya News) – The Islamabad High Court on Thursday ordered lower courts to decide the appeal of Bushra Bibi against illegal marriage case verdict within a month and the request for suspension of sentence within 10 days.

Justice Miangul Hasan Aurangzeb heard the petitions of PTI founder Imran Khan and Bushra Bibi in the illegal marriage case and ordered the session’s court to decide within 10 days on Bushra Bibi's request.

Advocate Salman Akram Raja submitted that never in his career he had seen that a judge transferred a case like this.

He argued that a session’s judge had heard the case and it was transferred when he was to announce reserved verdict.

He requested the IHC to order Session’s Judge Shahrukh Arjamand to pronounce the reserved decision, or the IHC announce decide after hearing the appeal, or the appeal be transferred to the Session’s Judge West.

Advocate Raja submitted that the court set a time for the session’s court to decide the appeal. The trial was completed within two days and now the appeals should be heard the same way.

Khawar Manika's counsel Rizwan Abbasi argued that his client objected to the judge but he rejected his application. He objected again and the judge sent the case to IHC. The IHC administrator referred these appeals to the Additional Session’s Judge West.

Advocate Abbasi opposed the transfer from additional session’s judge to the session’s judge.

After hearing the arguments of the parties, Justice Aurangzeb ordered that Additional Session’s Judge Afzal Majuka decide both the petitions within the time fixed by the court.

It may be noted that PTI founder Imran Khan in his petitions sought instruction to the session’s judge to pronounce the reserved decision or requested the IHC to hear his appeal while Bushra Bibi had requested the IHC to order the session’s court to hear and decide her pending plea for suspension of her sentence.
