LHC orders addl CS Home to decide petition against Elahi's detention by Monday

LAHORE: (Dunya News) - The Lahore High Court (LHC) on Friday ordered the Punjab additional chief secretary home to take a decision by Monday on the petition against the detention of former Punjab chief minister Parvez Elahi

Justice Raheel Kamran Sheikh heard the petition of Mr Elahi's wife Qaisara Elahi. The petition also challenged detention of Parvez Elahi in Rawalpindi's Adiala Jail. 

At the outset of the hearing, Qaisara's lawyer Amir Saeed Ran argued that the bail was granted by the court in all cases to the former chief minister, but instead of releasing him, a detention order was issued. 

After hearing the arguments, the judge ordered Additional Chief Secretary Home Ghulam Sarwar to decide on the petition against Mr Elahi's detention by Monday and submit the implementation report on Aug 8. 

Detained for 30 days under 3MPO

On July 17 last, Parvez Elahi was detained for 30 days under Section 3 of the Maintenance of Public Order (MPO), Dunya News reported. 

Deputy Commissioner (DC) Rafia Haider had issued the notification stating that Parvez Elahi would remain in custody at the Camp Jail, Lahore for 30 days in order to prevent public disorder. He will stay in Camp Jail under the superintendent for the next one month.

The notification mentioned two cases have been registered against Parvez Elahi in Qila Gujar Singh police station under serious provisions, including attempted murder and one case has been registered in Ghalib Market police station under terrorism provisions.

The notification said there were three cases against Parvez Elahi who could harm law and order. It said Elahi was also wanted by police in these cases.

It said action was being taken as he could cause disturbance of law and order and should be detained. The action was taken on recommendations of the District Government, District Intelligence Committee and police.

Earlier, the capital city police on Saturday requested the Lahore deputy commissioner to issue a 30-day detention order for PTI president Chaudhry Parvez Elahi under Section 3 of the Maintenance of Public Order (MPO).

The SP Security submitted a written request with the deputy commissioner for the detention of Parvez Elahi, a former chief minister of Punjab, for disturbance of peace in three cases.
