LAHORE (Dunya News) – The Lahore High Court (LHC) on Wednesday dismissed a petition seeking stay of commercial plots’ auction at Walton Airport.
The LHC heard a miscellaneous petition against the auction for sale of commercial plots on Walton Airport land and has issued a written order.
The LHC verdict stated that it was the responsibility of the petitioner to prove that there was any irreparable loss but he had failed to prove any such thing. “It is a rule of thumb that before granting interim relief, the court must ensure that no public interest is affected,” it added.
LHC Justice Jawad Hassan issued an eight-page judgment stating that the government has planned to reduce poverty and promote business in Pakistan through the Lahore Central Business District Development Authority (LCBDDA). “In the absence of any obvious illegality, the court s intervention will adversely affect the steps taken by the government to promote the business.”
Justice Jawad Hassan said that the court could not issue an order which would impact the steps taken by the government for investment. “Interference with such measures could hamper the opportunities created by the government for business activities in Lahore,” he remarked in the written order.
The written judgement further stated, “How can a petitioner seek information from an authority under Article 199 of the Constitution and the court cannot intervene in this matter under this same article.”
