Moving ICJ against Kulbhushan's sentence is 'useless': Indian media

Pakistan will now be able to challenge ICJ's jurisdiction view of its revised commitment to the body

NEW DELHI (Dunya News) - Indian media has termed their government’s move to refer International Court of Justice against Kulbhushan Jadhav’s death sentence ‘useless’ as it will not yield substantial results.

‘The Hindu’ says that India will not be able to gain any productive result from the plea filed in ICJ as ‘Pakistan while revising its commitment to the ICJ on March 29 has withdrawn all domestic and national security related issues from the jurisdiction of the court.’

Days before Jadhav’s was handed over death penalty, ‘Pakistan had informed the court that issues related to its domestic sphere and national security issues would no longer be part of the ICJ jurisdiction.’

“Disputes relating to or connected with any aspect of hostilities, armed conflicts, individual or collective self-defence or the discharge of any functions pursuant to any decision or recommendation of international bodies, the deployment of armed forces abroad, as well as action relating and ancillary thereto in which Pakistan is, has been or may in future be involved,” stated the declaration made by Pakistan’s envoy to the United Nations, Maleeha Lodhi.

This might land India into a great trouble as Pakistan will now be able to challenge ICJ’s jurisdiction in the case in view of its revised commitment to the body.

ICJ has set the case for May 15 hearing. The plea filed by India has termed the conviction as “egregious violations of the Vienna Convention on Consular Relations.” India states that it has been repeatedly denied consular access to Jadhav.

India alleges that Pakistan arrested Jadhav in Iran and "was then shown to have been arrested in Baluchistan" on March 3, 2016. It claims that he was carrying out business in Iran after being retired from Indian Navy.

India also alleges that they learnt of the arrest through a press release and were later notified on March 25, 2016.
