Jadhav not an ordinary prisoner: Pakistan rejects Indian stance in ICJ
Pakistan refuted Indian stance, saying The Vienna Convention doesnt apply to Indian spy Jadhav
THE HAGUE (Dunya News) – Pakistan has filed a reply with International Court of Justice (ICJ) in Indian spy Kulbhushan Jadhav case on Wednesday stating that the issue cannot be treated under The Vienna Convention as Jadhav’s is a special case.
It was argued that Jadhav is not a common prisoner, hence The Vienna Convention is not applicable on him. Pakistan rejected the Indian narrative and apprised that ICJ does not hold jurisdiction to hear the case of a terrorist.
Foreign Office s Director Fariha Bugti submitted the reply in ICJ, stating that the Indian spy entered the country with the intent of spying and carrying out subversive activities. Apart from refuting the Indian stance, Pakistan said that the Indian spy was caught during terror activities and he confessed to running a terrorism network in the region as well as being funded by the neighbouring state.
The informed sources told Dunya News that now it will be India’s turn to respond to the arguments. Pakistan will have another chance to submit the reply after their response.
Pakistan’s legal team -- after holding consultation with all departments concerned -- had compiled a detailed reply in response to India’s stance submitted with International Court of Justice (ICJ).
Sources privy to development told that Pakistan’s response is based on The Vienna Convention and country’s ambassador in Holland has submit the reply. Attorney General Ashtar Ausaf Ali is overseeing the high-profile case on behalf of Pakistan’s government.
The detailed reply also covered all aspects including concrete evidence of Indian naval officer and in-service Research and Analysis Wing (RAW) agent Kulbhushan Jadhav’s confession of involvement in terror-related activities.
ICJ will now review stance of both countries and would fix the date for hearing. Pakistani legal team seems hopeful that their stance would be accepted by the ICJ.
It is likely that the hearing of Kulbhushan Jhadav case will be held in the middle of 2018.
Wife, mother allowed to meet
Meanwhile, Pakistan allowed the convicted Indian spy to meet his wife and mother on December 25. Jadhav has been allowed to meet his wife and mother on December 25, foreign office spokesman Mohammad Faisal said.
Jadhav’s arrest and confession
Jadhav was arrested on 3rd of March 2016 from Balochistan’s Mashkel near the border region of Chaman. In his video statements, Jadhav confessed to involvement in terror activities basically aimed at fate-changing China Pakistan Economic Corridor (CPEC).
